These Terms of Use (the “Terms”) govern your use of the MerryBlood application for Mac, iPad, and iPhone (the “App”) and this website (the “Site”). The App and Site are provided by Vadym Teslia, an individual sole proprietor based in Ukraine (“we”, “us”, “our”).
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1The App and your licence
MerryBlood is a personal record-keeping tool for tracking lab test results and vital signs over time. You define the tests you care about, record measured values, and view how each one trends against the reference range you enter.
MerryBlood is sold as a one-time purchase through the Apple App Store — there is no subscription and no account. Subject to these Terms and to the App Store’s terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on the Apple devices you own or control, for your own personal, non-commercial use.
Your use of the App is also subject to Apple’s Licensed Application End User License Agreement (the standard Apple EULA), which applies in addition to these Terms. Where these Terms and the Apple EULA conflict, the Apple EULA governs your licence to use the App to the extent of that conflict.
2Acceptable use
You agree not to:
- copy, redistribute, resell, rent, or sublicense the App;
- reverse-engineer, decompile, or disassemble the App, except to the limited extent permitted by applicable law;
- remove or alter any proprietary notices in the App; or
- use the App in any way that breaks applicable law or the App Store’s terms.
The App, its design, and its name are our intellectual property and remain ours. These Terms grant you a licence to use the App — they do not transfer any ownership to you.
3Medical disclaimer
Important — please read
MerryBlood is not a medical device and does not provide medical advice, diagnosis, or treatment. It is a personal tool for recording and visualising numbers that you enter yourself.
The “in range”, “high”, and “low” labels the App shows are calculated purely from the reference ranges you type in. They are simple arithmetic against your own numbers — not a clinical interpretation, and not a judgement about your health.
Always rely on the reference ranges, results, and advice provided by your laboratory and a qualified healthcare professional. Never disregard professional medical advice, or delay seeking it, because of something you saw in this App. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
4Your data and backups
MerryBlood stores all of your data locally on your device. We do not host, receive, or keep a copy of it (see our Privacy Policy for the full picture).
Because the data lives only on your device and in any backups you create, you are responsible for keeping your own backups. The App can export and back up your data as plain CSV files to a folder you choose. We cannot recover, restore, or retrieve data that is lost, deleted, or corrupted, because we never have a copy of it.
5Purchases, payments, and refunds
All purchases of the App are made through the Apple App Store and are handled entirely by Apple under Apple’s terms. We do not process payments and never receive your payment details.
Any refunds are requested from and granted by Apple, in accordance with the App Store’s refund policy. We are not able to issue refunds directly.
6No warranty
The App and Site are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any calculation, label, or chart it produces is accurate or fit for a particular purpose. You use the App at your own discretion and risk.
7Limitation of liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, arising out of or relating to your use of (or inability to use) the App or Site — including any decision made or action taken in reliance on the App.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.
8Apple
These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide any maintenance or support for the App, and is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or third-party claims.
You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that Apple has the right to enforce these Terms against you as a third-party beneficiary.
9Changes to the App and these Terms
We may update, change, or discontinue the App or any of its features at any time. We may also revise these Terms from time to time. When we do, we will update the “Last updated” date above, and the revised Terms take effect when posted. Your continued use of the App after a change means you accept the updated Terms.
10Governing law
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law rules. This does not deprive you of the protection of mandatory consumer-protection rules of the country where you live.
